1. Agreement to these terms
By accessing or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Platform on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, do not access or use the Platform.
2. The service
The Platform is a business-to-business tool that WEBARQ uses to manage digital advertising campaigns for its clients across platforms such as Meta (Facebook/Instagram) Ads, Google Ads, and TikTok Ads. It provides campaign and performance reporting, budget and billing reconciliation, reporting, and AI-assisted recommendations and workflow tools for authorized users.
3. Eligibility and authorized access
The Platform is not open to public registration. Access is granted by invitation only to WEBARQ staff and to authorized representatives of WEBARQ’s clients. You may use the Platform only within the scope of the role and permissions assigned to you, and only for legitimate business purposes related to the services WEBARQ provides.
4. Accounts, sign-in, and security
Sign-in is performed through our single sign-on provider (Timegem SSO). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use or suspected security incident. We may revoke or restrict access at any time to protect the Platform or comply with our obligations.
5. Acceptable use
You agree not to:
- access data or accounts you are not authorized to access;
- share your credentials, or allow others to use your account, except as expressly permitted;
- copy, scrape, export, or disclose data from the Platform other than as needed for your authorized work;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Platform or its infrastructure;
- use the Platform to violate any law, third-party right, or the terms of any connected advertising platform; or
- introduce malware or otherwise compromise the integrity or security of the Platform.
6. Third-party platforms and data
The Platform connects to third-party advertising platforms, including Meta, Google, and TikTok. Your use of those platforms and their data through the Platform is also subject to each provider’s own terms and policies — including the Meta Platform Terms and the Google API Services User Data Policy. You represent that you are authorized to access and manage the advertising accounts you connect or that are assigned to you, and you authorize WEBARQ to access and act on those accounts to provide the service. We are not responsible for the availability, accuracy, or policies of third-party platforms.
7. AI-assisted features
The Platform provides AI-generated insights, recommendations, and draft content. These outputs are advisory and may contain errors; they do not constitute professional, legal, or financial advice. Any action that affects live campaigns or spend requires explicit human review and approval before it is applied. You are responsible for decisions made using the Platform, and WEBARQ does not warrant any particular campaign result or outcome.
8. Intellectual property and your data
The Platform, including its software, design, and content (excluding your data), is owned by WEBARQ and its licensors and is protected by intellectual-property laws. As between you and WEBARQ, you and the relevant client retain ownership of the business data you and we input into or generate within the Platform. You grant WEBARQ the rights necessary to host, process, and use that data to provide and improve the service, as described in our Privacy Policy.
9. Confidentiality
The Platform contains confidential and commercially sensitive information belonging to WEBARQ and its clients. You agree to keep such information confidential, to use it only for your authorized purposes, and not to disclose it to any unauthorized party.
10. Availability and changes to the service
We strive to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time, and we may perform maintenance that temporarily limits availability. Sign-in depends on our SSO provider; if that provider is unavailable, access may be temporarily affected.
11. Disclaimers
The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, WEBARQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Platform. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Suspension and termination
We may suspend or terminate your access at any time, including if you violate these Terms, if your authorization ends, or to protect the Platform, our clients, or third parties. Upon termination, your right to use the Platform ceases. Provisions that by their nature should survive termination will continue to apply.
14. Governing law
These Terms are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-laws rules. The courts of Indonesia will have jurisdiction over any dispute arising out of or relating to these Terms or the Platform, subject to any mandatory rights you may have under applicable law.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Platform after an update constitutes acceptance of the revised Terms.
